Statement by H.E. Mr. Tofig F. Musayev Permanent Representative of the Republic of Azerbaijan to the United Nations at the Security Council Arria-formula Meeting on “Commercial Spyware and the Maintenance of International Peace and Security”

As the concept note outlines, this meeting aims to build on discussions and to advance global dialogue on the commercial spyware challenge. In this regard, one of the questions identified for such discussion is how could Member States govern the proliferation and use of commercial spyware, so as to contribute and not undermine international peace and security.  

Above all, whatever the spheres of activities or the threats and challenges to address, the respect for the sovereignty and territorial integrity of States and non-interference in their internal affairs are fundamentals to maintaining international peace and security.

Evidently, proceeding from this basic understanding, the Security Council must not be misused to divert attention from flagrant violations of international law and the responsibility for such violations.

Against this background, it is astonishing that the concept note for this meeting, citing unnamed so-called independent researchers, mentioned part of Azerbaijan’s sovereign territory with an invalid name and at the same time refocused the attention from the root causes and consequences of the conflict, thereby ignoring key facts such as the illegal territorial claims and the resulting aggression against my country since the early 1990s and the occupation and large-scale ethnic cleansing of its territories over the subsequent nearly 30 years.

The authors of the concept note should have known that what they erroneously called “Nagorno-Karabakh” long ago ceased to exist as an administrative and territorial unit. This area is an internationally recognized sovereign territory of Azerbaijan, the legal name of which is the Garabagh Economic Region.

In concluding, it is pertinent to remind in this regard that the respect for the sovereignty and territorial integrity of States, including the recognition and use of geographical names established by legitimate and competent national authorities in relation to their sovereign territory, is a duty placed on all States and is an absolute imperative for the maintenance of peace, security and the legal order based on the universally recognized norms and principles of international law and the Charter of the United Nations.
